1. The following terms and conditions apply to all contracts between you and us.


2. Definition:
2.1  “We”, “us”, or “our” refers to Chinese Overseas Christian Mission Living Water Bookroom, hereafter mentioned as COCM Bookroom (2 Padstow Avenue, Fishermead, Milton Keynes MK6 2ES, United Kingdom; 01908-234100). The COCM Bookroom is part of Chinese Overseas Christian Mission (COCM) registered at the same address ( Company No: 7106567; UK Charity No: 1135892 ).
2.2  “You” or “your” means the person or the company ordering products under this Terms and Conditions.
2.3  “Product” or “products” means the product or products you have ordered from us.

2.4  “our Web” means bookroom.cocm.org.uk


3. The website  bookroom.cocm.org.uk is created principally to provide information on our products.


4. Prices and VAT:
Unless mentioned, prices shown on our web include VAT, where and to the extent that VAT is required to be applied to the product under UK VAT law. Package and Delivery charges are extra. We reserve the right to change prices listed and to withdraw the selling of any particular product without any notice. Prices advertised online by us are valid only when the product is available in stock.

5. Orders, availability and mistakes in pricing:
5.1  All orders for products are subject to availability and should be made: (i) online order via our Web; or, (ii) by email to bookroom@cocm.org.uk ; or, (iii) calling us direct on 01908-300533 during our opening hours. The availability information of the products on our Web is updated regularly, but it is possible that, in some instances, the product may become unavailable after the updates but be shown on this website as available by mistake. If this is the case, we will inform you of the situation and your order will be dispatched as soon as the product becomes available to us.
5.2  Although we make every effort to ensure the prices on our Web correct, mistakes may sometimes be made. We reserve the right to cancel any order where obvious errors in pricing or product description have occurred. If we discover a mistake in the price of the products you have ordered, we will tell you and give you the option of either reconfirming your order at the correct price or cancelling your order. If we are unable to contact you or we receive no reply from you, we will cancel your order. Any monies received if any will be refunded.

5.3 We only enter into the contract with you when your order placed, right amount received, the availability checked and e-mail sent from us confirming the order.

6. Payments:

6.1  If you place the order via our Web, you will be directed to a secure site for card payment. There might incur a charge. We accept UK major debit cards and credit cards. American Express Card will not accepted. For using Company cards and foreign cards please call us for the charge.

6.2  If you are ordering over the phone or via e-mail, we will advise you of the method of payments.

6.3  We will dispatch your orders as soon as we have received payments for your orders and associated postage costs.

7. Dispatch and delivery:
7.1  We strive to dispatch and deliver your orders as soon as possible. However, delays can sometimes occur. We are not responsible for any loss in your part as a result of the delay. Where the product is already in our stock, we will agree to cancel the order of that product and refund the money if the delay is beyond reasonable.

7.2     We will try to use different carrier to deliver the products. We are not responsible for the products lost in transit. You can choose the delivery means that provide insurance cover against the loss or damage during the delivery.

7.3     When you receive the products, make sure there is no sign of damage of the products due to the delivery. You should mention to the person if there is any damage.

 

8. Completion of contracts:
Completion of the contract between you and us will take place on dispatch to you of the products ordered. This will be deemed to be our acceptance of your offer and to have been effectively communicated to you. You will become the owner of the products you have ordered, when the products have been dispatched to you.

9. Returns:
9.1  When you receive the products, check if the products are those you have ordered. Make sure they are right before you open the product package. Opened products are not returnable.

9.2  If you receive an incorrect or damaged item from us, please contact us within 7 days after the receipt of the products. The returned products should be unused and reach us within thirty days of receipt for refund or exchange.

9.3    We do not normally accept product return because you change your mind. In the event we agree, there will be an administration charge that covers the administration, P & P and Card charges.
9.4  Products may be returned by post in accordance with the following procedure: repackage the products securely and send the products together with your order reference, e-mail address, telephone number, posting address, and indicate whether you would like a refund or a replacement.  We need to receive the products first before we can process the return.

11. Privacy:
11.1  When you place orders with us via online, e-mail, or telephone, we collect certain personal information from you, e.g. your name, email address, telephone number, posting address, and billing address, for the purpose of processing your orders.
11.2  We comply with all applicable data protection legislation and will treat all your personal information as strictly confidential.
11.3  In order to process your order payment, the third-party payment processing and product distribution institution will handle the payments. They will receive the information from you in order to process the payment.
11.4  We may disclose Personal Information if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process in respect of our services; (b) protect and defend the rights or property of COCM; (c) act under exigent circumstances to protect the personal safety of our customers or the public; and (d) resolve customer service issues raised by our customers, where we believe this is reasonably necessary.
12. Restrictions:
12.1  By placing an order, you confirm that you are aware of any age restrictions on these products and that you are aged 18 or over.
12.2  Certain products are subject to delivery restrictions. Products can only be sent to UK addresses and certain products can only be sent to the UK billing address.
12.3  In some instances, we may decline to deliver parcels to PO Box addresses. We will contact you, if we consider the PO box address is appropriate for the transaction.

13.4  We aim to serve as many customers and we could. So we might put a restriction as how frequent and how many of one particular product that one customer ( including mailing address) allows to order form us so that our people can also access to the product.


13. Limitation of liability and disclaimer:
13.1. We will not be liable to you: for any loss of profit, administrative inconvenience, disappointment, or indirect or consequential loss or damage arising out of any problem in relation to the products you ordered which was not within our reasonable contemplation as a probable result of a breach of contract on our part at the time that our contract with you was concluded, or where performance of any obligations to you is prevented, frustrated or impeded by any circumstance or cause beyond our reasonable control.
13.2. We make no representations or warranties about the accuracy, completeness or suitability for any purpose of the information contained in the documents and related graphics published on our Web; or any of the products of whatever nature, details of which appear on our Web. All such documents and related graphics are provided, and any such products (where ordered) are accepted by customers, without such warranty of any kind.
13.3. We reserve the right to refuse to supply to any individual or company.
13.4. The information contained our Web may contain technical inaccuracies or typographical errors. All liability of us howsoever arising for inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
13.5. The security of information transmitted via the Internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of email or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part by borne by us.
13.6. All brand names, product names and titles used in our Web are trademarks or trade names of their respective holders. No permission is given in respect of use of any of the above, and such use may constitute an infringement of the holders’ rights.

14. Severability:
If any part of these Terms and Conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these Terms and Conditions will not be affected.

15. Governing law:
These Terms and Conditions and any contract between us and you shall be governed by, and interpreted in accordance with, English Law and the English Courts shall have jurisdiction over any disputes between us.

16. Statutory rights:
These Terms and Conditions are in addition to your statutory rights as a consumer, which remain unaffected.

17. All headings and sub-headings used in these Terms and Conditions are for the convenience of illustration only and do not constitute part of these Terms and Conditions.
